Prior to an amendment made in 2005, these laws were only applicable when the offence was directed at another person. Now they are applicable to any behaviour which will interfere with the public’s passage through or enjoyment of a public space.
Examples of behaviours that can result in offensive language or conduct charges include:
- Being drunk in a public place
- Wilful exposure
- Public nuisance
- Urinating in public
- Begging in a public place.
Public nuisance laws mean that it is an offence to behave in a way that is disorderly, offensive, threatening or violent.
If charged with offensive language or conduct you will be summoned to appear in the Magistrates’ Court.
The maximum penalty is 6 months imprisonment or a fine of $1334.50. However, this can increase if the offence takes place within licenced premises.
